Ali Aarrass is a dual Belgian-Moroccan national imprisoned in Morocco since 2010. He is a victim of multiple human rights violations, including torture and other ill-treatment, incommunicado detention and unfair trial.
His case is outstanding because of the Moroccan authorities’ failure to adequately investigate his torture reports, against an exceptional amount and quality of evidence that he was indeed tortured while in the custody of the Moroccan security forces.
Born in 1962 in the Spanish enclave of Melilla, in northern Morocco, Ali Aarrass moved to Belgium when he was 15 years old and obtained Belgian nationality in 1989. He returned to Melilla In 2005 with his wife to live close to his ageing father.
In 2006, the Spanish authorities suspected him of terrorism and began investigating him under the supervision of veteran anti-terrorism judge Baltasar Garzon. Garzon closed the case in 2009 after finding no evidence against Ali Aarrass.
However, the Spanish authorities imprisoned him in 2008 after the Moroccan authorities requested his extradition on fresh terrorism charges. While in detention in Spain, he was kept in solitary confinement for two years and eight months, which has affected him permanently. He went on hunger strike three times, but had to stop because of his worsening health. He was extradited to Morocco on 14 December 2010, against warnings by the UN Human Rights Committee and Amnesty International that he risked incommunicado detention, torture and unfair trial in Morocco.
These early fears have been confirmed by reports of subsequent human rights violations, which the Moroccan authorities have not investigated.
